1) Caught in the act of the exchange
2) Proof that at least one party has had a history of prostitution arrests, or the area is known for prostitution.

Book a hotel first, go up to the room, then have her either come up before or after you. As long as she's legit, there's no way to pin it.

The big thing is traffic, meaning how many prostitutes stay there. For example, if there's an intersection known for prostitutes, then a hotel next door is a hot spot that's usually paid for by the pimps. Unless you're a cop who knows that beat, that's your only real indicator. You're playing a risk regardless picking up a street girl, but the smartest thing is to not linger. Go away from a major intersection, or where you see a lot of them.
