1) force someone suspected of a crime to have blood drawn (probable cause)

The crash happened on the 26th and the officer tried to take the blood on the 31st. That's a long god damn time to bullshit a charge. Furthermore it has to be an actual arrest not just probable cause and that's got a higher bar to clear. He's not trying to unlawfully search for marijuana he's trying to get blood which the supreme court has specifically ruled requires a warrant. For any evidence he acquired to be admissible he'd also have to prove the initial charge was justifiable. Really he was just plain fucked and should have walked away. But of course he couldn't do that because he had his LT breathing down his ass to get something that would prevent the poor bastard from suing the department.
