I don't think he was guilty of murder (he had reasonable fear for his life from the mob), but they have a pretty good case for manslaughter. You're only allowed to act as a reasonable person would under the circumstances. The defense (especially if he's relying on a public defender) will have a very tough time making the case that a reasonable person, faced with a mob, would decide to go through the mob rather than going in reverse.
