I don't know. I'm not able to stomach sitting through the film about the trial (((Denial))), although I am curious as to how they managed to gloss over some of the inconvenient facts about Auschwtiz, Treblinka and the others. For the defence to win they had to prove that Irving was wilfully falsifying history out of anti-semitic hatred. I think in the end they just did the Clinton trick and dragged the man's character through the mud on hearsay and half-truths.

LLB here. I'll explain. Irving claimed that he had been libelled by Deborah (((Lipstadt))) because she called him a Holocaust denier and accused him of falsifying data.

Irving claimed that the accusation of Holocaust denial was false and had damaged his reputation as a historian. He sought damages for his hurt feelings, loss of speaking engagements and the loss of book sales.

In order for something to qualify as libel, the following two tests must be met:
- the statement must be objectively false.
- the statement must have damaged the plaintiff's reputation in a quantifiable way.

Unfortunately for David Irving, he is, by any rational definition, a Holocaust denier in that he denies that the Holocaust took place. He also misrepresented a great deal of material taken from the Reichsarchiv and had been getting called out on this since the early 1980s. Therefore Irving effectively had no case. Despite this, he insisted on proceeding with the suit. His barristers did a good job of shifting the goalposts and trying redefine what "Holocaust denial" meant but they were fighting a losing battle.

During the course of the case, Irving ran up legal bills in excess of £2 million. In the end, he lost. The court found that he had not proved that libel and he was left with a very large bill for legal fees.

It's a salutary lesson in not initiating legal proceedings unless you actually have a case.
