For how to work out law enforcement and national defense read Chaos Theory by Robert Murphy. Essentially every building, square, park, etc. would be owned by someone and they would require to sign contracts (either explicitly or implicitly by entering their property) that would define the laws that apply in that area. It would basically give them the right to arrest you if you were to violate those laws.
As for punishment Murphy has two interesting ideas: Fines could be very high and you would have what is basically a "crime insurance" to pay fines above a certain amount, although of course that would then increase your premiums. If you don't have insurance you might not be allowed into certain areas or people might not want to do business with you since they know they could get screwed by you committing a crime and not being able to reimburse them. As for jail, the book suggests that prisoners could chose among the private prisons since the violated party would have no reason to object as long as the prison is secure enough you can't escape.
