East Asians specifically get test scores which should predict better academic and post-graduate performance than we actually see. The "discrimination" probably comes in to effect on south/southeast Asians who get lumped into the same category and don't show this test/performance disparity but this is a seriously edge case because test scores aren't the only metric for admittance and many SE Asians get AA points for being "disadvantaged".

First, let me point out how hilariously dishonest the NYT is being with that title. They mention that the DOJ is taking on discrimination of white students, but do not mention until much later in the article they are also taking on discrimination of ASIAN students, because the latter is much harder to rationalise, and the NYT appearantly feels the argument for doing so is so weak, they would rather frame this as being about white.

Anyways, I think it's a legitimate case. I think affirmative action has long passed its due date, and this isn't to say discrimination does not exist in the United States, but I do not believe that affirmative action reduces the net amount of discrimination. The justification behind affirmative action, which inherantly is discriminatory against racial groups, is that it was fighting fire with fire more or less, it was needed to reverse the discrimination some groups otherwise saw. We have Asians, who did not have the red carpet rolled out for them, now surpassing all racial groups at higher learning. Nobody with a straight face is saying this has anything to do with racial discrimination at the expense of non-asians. The politically correct give a "culture of education" type explanation for it. Nonetheless, this effectively means, Asians are being punished for being successful, against all odds, with racial discrimination.

The Idea with affirmative action, originally, is when there was no more discrimination, affirmative action wouldn't discriminate, because it would have no need to, since people would be enrolled equally, given they're equal. Reality is not matching that expectation. We are literally kicking Asians out of schools to put more Whites in the class and saying we're fighting against a history of systemic racial oppression. It's fucking absurd.

I don't see how the DOJ loses this case given the supreme court and the rationality of the arguments against AA.
