However, its arguable that Transgenderism is not a "sexual orientation" as gender dysphoria is classified as a mental disorder by the DSM IV. Rational basis review is the minimum standard a law must pass to be constitutional. This means that the law is rationally related to a legitimate governmental interest in fact or hypothetically. The burden would be on the transgender plaintiffs to prove the law is arbitrary, irrational, or capricious.
Here, excluding transgenders is rationally related to the governmental interest of saving military costs associated with fielding such service members. These costs would include medical for hormones and transition surgery, sensitivity training, and insurance. Because the law meets rational basis review, it is constitutional and the burden is on the plaintiff to prove otherwise.
