The only reason he was acquitted was because the jury didn't feel he showed culpable negligence as required for the charge he was being brought up on (2nd degree manslaughter). There's no evidence that he actually thought he saw a gun; the most probably explanation is that he was jumpy going in due to hearing the description of a robbery suspect, and reacted in an unreasonable, but not-illegal-for-a-cop manner.

Cops get a lot of lenience and only when it's blatant (like the guy who lied about having to wrestle the Taser away from the suspect when in reality he just shot him in the back as he slowly lumbered away) do they actually get convicted.
