The issue here isn't whether or not they are committing more crimes. It's that they are being charged with more serious offenses than white people who have committed the same crime;

e.g. If a white man gets publicly intoxicated, stumbles down the sidewalk, bumps into a woman, and knocks her down, he'll be charged with public intoxication.
