LIBS ON SUICIDE WATCH

Kennedy's retirement would allow Trump to appoint another judge, thus giving us 3 staunch conservatives, 2 leaning conservatives, and 4 liberals.

The entire point is a balanced bench and that's a tacit agreement between both sides nobody's dared to breach.

It always amuses me when judges are considered "conservative." A conservative judge is simply one that enforces the laws as written, in other words, nothing more than being a judge.
>>
>>131169141
>During the Obama presidency, some progressive lawyers and activists called for Ginsburg to retire so Obama would be able to appoint a like-minded successor,[112][113][114] particularly while the Democratic Party held control of the U.S. Senate.[115] They pointed to Ginsburg's age and past health issues as factors making her longevity uncertain.[113] Ginsburg rejected these pleas.[53] She affirmed her wish to remain a justice as long as she was mentally sharp enough to perform her duties.[53] Moreover, Ginsburg opined that the political climate would prevent Obama from appointing a jurist like herself.[116]

>>
>>131169319
It's impossible to enforce a law literally. Words have different meanings in different contexts and can't account for every situation imaginable. That's why we have judges, to interpret those words. Otherwise we wouldn't have needed judges.

The past couple of centuries had many a dictator who tried to do away with judges or with interpretations by judges, only to fail every single fucking time because of the nature of language is impossible to apply law without interpretation

This. Clarence Thomas is consistently the most loyal jurist to the original vision of the Constitution. He regularly writes opinions where he advocates for revisiting old cases that despite being long settled precedent do not conform to the original public meaning of the Constitutional provision from which they flow. He is absolutely my favorite Justice and should be worshipped for any fans of strict federalism.

In countries with real justice, an act not contemplated by a criminal statute is not cognizable by a court. The evolution of law that you're discussing is known in the west as 'the common law.' The common law doesn't create law, it merely applies existing principles to discern whether present circumstances fit within these principles.

There is, for example, no Constitutional right to an abortion. This is created-law, and therefore only within the province of a legislature. If you believe that you understand dictators, then you should consider the outrage of a single body of government capable of making and enforcing laws.

Laws are enforced all the time...

Yes. Anon is correct. It's called "common law" and it's our system in the Anglo world. We interpret laws in the context of the infinite complexity of reality, rather than treating our laws as the programming code for society. This allows for a lot of liberterian wiggle room, in principle. We take for granted in the Anglo world that if something is NOT explicitly illegal, then we are allowed to do it. In the EU and elsewhere, if something is not explicitly illegal then it is in a category of behaviors considered "unregulated," and no one feels safe doing it.

The problem isn't that left-leaning judges interpret the law, it's that sometimes they can just be biased hacks who ignore precedent altogether.

Scalia and CT often would issue joint opinions that the others justices would not join.* When I would see this, I would immediately read them. Instant gold, every time...

* Justices are allowed to issue dissenting opinions when the disagree with a court decision, or 'concuring' opinions when a judge agrees with a court's holding, but for different reasons.

Lol sweden you're so retarded. The supreme court is supposed to be explicitly non-partisan, the judicial branch in total is supposed to be explicitly non-partisan. They're supposed to have an allegiance to the law and the constitution and not allow politics to shade their judgement. You're not paying attention; this is not a sea change in party ideology (Dems) - these are the death throes.

You cannot compromise on the interpretation of legal text. That's the whole point of the concept of law as an abstract mechanism for organizing society: that they are above the whims of any one man and can be eternal and thus predictable to those over whom they have jurisdiction. Scalia explains this well when he criticizes the methodology of his SCOTUS colleagues who grant themselves the privilege of deciding what the purpose of the law is as opposed to just saying what it actually is.

The problem with doing that is it basically illegitimizes the entire platform of the Democratic Party as it has nothing to do with the foundational principles on which the Constitution is bedded.

>How much people must hate her to have wanted Trump instead

Believing people voted for Trump simply because they "hated him less" is a mistake Democrats regularly make.

Fact is, Trump ran an extremely upbeat campaign. He had a great sense of humor, constantly making jokes while also making sure to talk about how even though the country may be having a hard time that it was still possible for Americans to turn it all around.

You can even look at his recent comments about apprenticeships to get this same sense of positivity. Rather than talk about those wanting to engage in apprenticeships as some less fortunate group, he talks about them as those that have some fantastic talents that some Ivy league graduates don't have and that they can do fantastically well with how much money they can make in such careers. He avoids making it sound like he's pitying Americans and instead talks up everyone.

Democrats made their usual mistake of interpreting all of Trump's jokes in an autistic manner. Which probably didn't help matters.

Democrats won't improve as a party until they stop being so fucking negative and try being as positive as Trump.

I don't deny that the Democrats need a sense of humor and few points on how to campaign. However, I don't think a lot of people were joyful in voting for Trump, at least among the people whose votes swing elections. Despite all of the talk of "fake" news and "skewed" polls, both Trump and Hillary's approval ratings were in the 30's. Hell, Trump's approval rating is still there. While some of us talk about Trump's approve-disapprove numbers being skewed, I've never heard from someone who feels that Hillary's low numbers are skewed as well. I don't think the country was very satisfied with this campaign. That's the point I"m trying to make. Had Hillary not spent decades antagonizing people through her personality and entitled detachment from the people and causes she claims to champion the outcome could have been very different.

>Despite all of the talk of "fake" news and "skewed" polls, both Trump and Hillary's approval ratings were in the 30's

You're looking at the polls wrong.

Democrats always despise Republicans and would never say they approve of them. Whereas Republicans are fine with expressing disapproval of their Republicans.

You can look back on the numbers for Bush and it was much the same, most all Democrats hating him with some Republicans agreeing.

Hillary's numbers were legitimately low because Democrats had no reason to be biased against a Democrat while Republicans did their typical "trying to be fair" bullshit yet still didn't like her.

So yes, the approval polls were skewed against Trump/Republicans and not so against Hillary.

Also you need to keep in mind about a third of the country identifies as Republican, a third independent, and a third Democrat. Yet many polls would base their numbers on the idea that Democrats make up over 35% of the country, some even suggesting as much as 45% of the country identifies as Democrat which is simply not true. Which means you always have to try and look at the numbers for each specific group to see how things are truly doing.

>I don't think a lot of people were joyful in voting for Trump, at least among the people whose votes swing elections

Trump got so many voters excited and joyful that it is one of the prime reasons he won swing states. Trump voters would talk about being willing to walk on glass to make damn sure they voted for Trump.

fucking this. there is no compromise in terms of left and right there is the law and thats it. Any judge who doesnt follow the interpretation of the legal text is one who shouldnt be there.

How has it reached a point where we discuss the appointment of these people instead of outright saying no is why the right keeps losing. We allow the left to keep shifting the window their way so in the end we end up arguing not for a judge who interprets it how it is but rather a judge who might interpret it how it is half the time and the other half the time do what he pleases.

This is why the right loses. Its why they have lost every control of every institution and have watched their nation crumble around them.

Such an audience enjoys agreeing with people, sitting and reading the thoughts of someone so like themselves and what they think of the latest event. What was once the opinion section has become front page. When you would read an event on the front page and then go to the opinion section to hear different thoughts on the matter you now get one hivemind opinion on the matter and that is all there is to it. Do these sites even have an opinion section anymore? How do they justify having one when they post it anywhere in their paper?

>U GUISE SHOULD PLAY BY THESE ARCANE UNSPOKEN RULES THAT ONLY APPLY TO YOU AND NOT TO YOUR ENEMIES
>WHY ARE YOU BREAKING THESE ARBITRARY CRIPPLING RULES YOUR ENEMIES SET OUT BEFORE YOU IN ORDER TO HINDER YOUR ABILITY TO PUSH YOUR OWN AGENDA WHILE ENABLING THEIR OWN?

Fuck liberals and fuck balance too. No Democrat would hesitate for even a split second before filling the entire SC with Ginsberg-tier Leftist Activist Judges. Not one fucking second. Obama already spent both of his terms packing every courtroom he could with Liberal Hacks.

I hope Ginsberg and Sotomayor die and Kennedy retires.

Don't forget, that fat dyke kike is clearly due for a massive heart attack. It makes me wish there were cameras in the supreme court just so we could enjoy .gifs and webms.

i think ted would be better as a justice than a president maybe that is his endgame
>>
>>131229288

Well they seemed to have a productive private meeting at Trump Tower pre-inauguration and Cruz says the bad blood between them is over. Trump is getting a full dose of how cancerous leftist judges are, he needs serious friends in serious places who are willing to fight for his agenda and break the enemy's back.

Ted would do infinitely more damage to the left as a justice than a president. Best of all, imagine the liberal melt down.

The constitution isn't liberal or conservative.

It just is.

"Muh living document" has ruined this nation.
>>
>>131229015
This...this is absolutely the truth. the DNC wouldnt pause for one second in securing absolute power if they were able to. We need to fill the SCOTUS with constitutionalists. Fuck trump should expand the SCOTUS if he has to bring that number up to 13 or something all filled with non political constitutional originalists. That would give america a shot for the next 50 years at resisting the left wing take over, should they ever rig enough votes to get in power again.

Truth is the next step, congress/senate needs to be cleared of lifetime politicians who always talk big but would rather do nothing and get elected again than take a risk to fix this country.

So it's fighting cancer personified with cancer.

If people are freaking out because the Supreme Court has become this game of death and retirement to make your party dominant in the judicial branch (and still don't want to take away their power of judicial review) then why don't they introduce terms? Make them judges for 12 years I don't know.
>>
>>131229666

Check those sixes.

Cruz confirmed for next SCOTUS justice and will reign brimstone on the liberal satan worshipers.

I'm actually surprised and somewhat startled when I see an article like this and it's not written by a Jew. Then I realize it's probably just a cryptokike.

1488 will begin early 2021 at this rate. God speed trump.

I would be happy with a anti-fed/anti-irs liberal judge though.

Try it Trumptards, we'll pack the Supreme Court, double the size of the House of Representatives, make gerrymandering illegal, compulsory voting, and admit Puerto Rico and DC as states.

You will be finished.

Just say you hate this country and what it represents. Just fucking say it already. Why do you faggots on the left pretend to have America's best interests at heart when really all you want is to destroy it? Let's drop all pretenses and see who comes out on top. I'm tired of fucking rhetoric.
