This depends largely on the circumstances of the case and the crime in question, although you're mostly correct.
For example, a magistrate would probably laugh if you tried to pull this for a traffic ticket.
However, a jury might be hesitant to convict someone on trial for manslaughter if the driver's identity is in question. Although even here you'd probably need more than 'lol you can't see my face it's not me'.

Friend of a friend was riding with her boyfriend back in the day, she was on the back when he hit a tree and died instantly. She was unconscious when the EMTs found her and she woke up in the hospital, the doctor told her it was nothing short of a miracle she survived the crash without a helmet. She said she was wearing a helmet. In the crash the helmet was destroyed so totally that there was nothing left that the EMTs had to pull off of her head. No exaggeration whatsoever to say that helmet saved her life.
