The spots are on private property, not public. It's never going to be "illegal," they will just have you towed just like if you park in a businesses space that you aren't a patron of, it's the property owners right to have your car removed.

In my city, there are two public parking garages owned by the city. The EV charging spots are reserved for EV cars being charged as clearly listed on the signage. So if you park your non EV car there, you're just going to get towed to impound.

Now, if you're talking about un-monitored spots, then that's different. As with many things, it's up to citizens to report such things so that the car can be towed.
