Meet the Barnacle, it adheres to the windshield using two pump-activated commercial grade suction cups. Should the drivers try removing the Barnacle , a built-in alarm will sound. Once they've paid their fine , drivers will be given a numerical release code, for the Barnacle on their car. They then have 24 hours in which to return it to a drop-off location.

Because they have no authority to? They can cite you for 'breach of contract' but they can't fine you, only pester you and attempt to make you pay on your own will. Private companies have no authority to enforce fines of any kind, clamp you or tow you.

Realistically the most they could do legally speaking is start some sort of civil dispute, since parking outside the agreed upon time would be a tortuous trespass.

It is illegal to interfere with a law enforcement device. I believe this law is standard in all USA municipalities.

Additional fines or jail sentence are be imposed if you damage or remove a boot. So those laws should apply to a Barnacle as well.

Your knowledge is very old. They can legally tow if they have a sign up saying you can be towed. All cities copycatted the first few cities that had such laws survive legal challenge where a private property owner can have a private tow company tow a car without a police officer present. This is why you have tow signs in all the usa cities saying improperly parked cars (as determined by the property owner) can be towed at the car owner's expense.

That approach totally fails in my area as proven with tows already. Lots of times, tows have caused damage to cars' front air dam fascia depending on where and how they attach the winch cables to pull the illegally-parked car onto the flatbed. The tow company is NOT obligated to pay for such damage caused during towing.

To be fair, the homeowner did park his car in his driveway and got booted. Just because the real estate agent told him "Sure, no problem, please buy the property!" doesn't make it legal to park in your driveway. In my neighborhood, oversize vehicles are to park in the special separate parking lot reserved for such vehicles. There is a monthly parking fee (rounded up to the full month) for parking in that lot. That lot is about 1/3 mile walk (one way) from my house, so I'm glad I don't have a huge truck that doesn't fit inside my garage (low height opening). Some of my neighbors have tall detached 3-car garages that can fit tall trucks or even a camper truck inside. Not that anyone here has one of those ugly things.

This is how neighborhoods should be.

Meanwhile, downtown, you have homeless that will break a car window in order to crawl inside to get out of the rain or snow. They can't be charged with breaking the window due to DINDU (no witnesses).

I live on 10 acres in N. Ga that's unrestricted with no HOA. On the other side of the road in front of my property is a gated HOA neighborhood and from the end of my driveway I can see a high end spec house that's 2x the square footage of mine.

My property appraises for 200k more than the one in the gated community and because I have an agricultural exemption my property taxes are 75% less. Only a fool would buy into a HOA community.

I had this same thought with my motorcycle a while back. Went to dinner at a new restaurant, didn't google map it or anything, find out the whole lot is stones. Actually that's very clever. You can drill through tempered glass but you have to go SLOW and use light pressure.

Just pop a couple of 1mm holes in your windshield and plug them with little rubber bungs. Pull them out if someone barnacles your windshield, release the baranacle and be on your way.

You didn't damage the device or harm it in any way, so it's hard to argue that it's illegal.

Somebody should disassemble one and figure out where the battery is.

Just drill into the battery to kill it, and then drill out the suction cups to remove it. 3 holes, easy. Don't matter how much (if any) hardened steel shields the electronics, carbide bit will make short work of that.
