I'm the guy who's had a car in the shop for 2 years now.
Update, I called him and he said it's all painted and has to put back on the headlights and taillights and all that and it'll be done in a few weeks.
Called my mom and I guess that's where he was at the beginning if March.

He said he'll call me within a week to come and see it in person.

I'm never getting my car back am I?

We think he took the insurance claim money and paid other shit off with it and has been using the profits from the rental cars to slowly work on our car.

My brother hit a pole 2 weeks after my mom got it for me.
Afterwards she bought me a cheap x300 ($2000 it was a great deal) so I've been using that. It's not like I haven't had a car.

It sat on the tires for 2 years? The tires have a pressure spot now due to the belts shifting? If a car sits that long, it should do so on jackstands.

Remember that water vapor can cause rust in the car like that unless it was properly prepared for long term storage.

Seals can also go bad from standing still in one position for a long time. So you will have to check for slow oil leaks now. You will need to look up what to do to bring a car back to life out of longterm storage.

That car has taken on additional damage for not moving for two years. The liquids in the car along with seals need to be exercised or bad things happen. Were all the liquids drained and the inside of engine stabilized of water? I wonder how much rust there is in your water pump?

He took your money in advance. If he charges additional money for it after 2 years, he needs to be sued for fraud in court and given MAXIMUM sentence. What he did was against the law for repair work in my state and probably in yours too. So you should look up the laws ahead of time and be ready to shove it in his face if he makes claims that you owe him for the repairs since he already took the insurance money.

The car looks mistreated in the photo as it sat in one spot on its tires for 2 years. The engine is probably full of rust by now. The gasoline evaporated and left sludgy something residue behind I bet in various places of the car fuel system.

If he tells you he ran the engine for a short time occasionally, then that actually makes it worse because short runs generate water vapor in the oil from blowby and the engine crankcase doesn't get hot enough to evaporate the water out of the oil.

Before you run, you have to check all fluids and the oil dipstick. Don't know what to do about the gas tank contents.

Since you didn't walk away, he then did the bare minimum repairs to make it run and still took more money for repairs in the meantime as you said. So, as of now, he is hoping right now you will take it back in shitty BARELY running condition just because you are glad HE claims it is done. It is not done unless YOU claim it is done. Two years is bad. WHat advice does your insurance company have for you about a repair shop that has strung you along for two years? What would they do? The insurance company rep probably knows the name of the law for such occasions when the shop claims it can do the repair, takes the money, waits forever, and then gives it back to you in poor condition and with additional damage.

The shop can say they are not responsible for additional damage, but under the laws of due diligence, a shop is actually responsible for some things. If the shop failed to exercise due diligence, then you can sue them successfully for some things.

Brakes work for the first 10 uses.

They start to fade a lot and you need to press the pedal more to stop.

After the 10th use, the seals finally gave way due to 2 years non-use, leakage, and rust. Losing fluid each time you pump brakes.

NEW ACCIDENT DUE TO NO BRAKES. The shop hoped for this situation because now he is off the hook for bad or faked repairs. He will blame all problems you now find on your fresh new accident due to "LOL no brakes" after you used the brakes 10 or so times.

Happy days again for the cheating shop. Blame free due to OP having no brakes accident on the way home.

Anyways, if you are able to do oil change at home, inspect the oil. Or you might even send it to Blackstone Labs for a test analysis. They will also tell you if coolant is in there (a bad sign).

Anyways, I suppose you have your pre-inspection checklist handy before you accept the car back from him and sign the paperwork saying that you officially got the car back.

If he is too nervous, then you know he has faked repairs.

One weird thing to me about these stories and anyone who works in a shop that's either high end, in a major city, or both, is the absolute WORST thing for a shop is having a car sitting around for too long. Surprised that a insurance company would pay up BEFORE any work is complete.

When I had a fender bender my insurance was very clear... Take the car to whatever shop you want and email us their contact info, once work is complete make sure you are thoroughly satisfied with repairs before signing anything, then we will handle payment.

Also, OP, two years is too long for any kind if repair, let alone one paid for by insurance. You need to get onto your insurance company and have them put pressure on the repairer to finish the job, failing that, have them take it to another repairer. I'm gonna go ahead and call bullshit here. If it's totalled, it's totalled no insurance company in the U.S. Is going to let you take it to a special snowflake shop to get it repaired. That puts them on the hook for all repair costs, all storage costs if the car cannot be repaired, and any parts the mechanic buys if the car isn't repaired. I have worked in insurance for years and no company I know of does business this way. They would have recommended one of the shops they have an agreement with or had an estimate written by a staff estimator. Calling BS here anon

You neglected to say "properly prepared" as this car was probably not prepared for long term storage. The shop is run by a careless "i don't care" repair person who misused the insurance money AND even got extra money beyond the original insurance money.

OP, do NOT sign off on the car unless the work is actually completed. This repair guy is going to do whatever it takes to scam you into signing the acceptance form that you are taking the car back "as is".

Hot glue holding the headlight in place long enough to fool you on a test drive? Don't be so fast to sign the paperwork just because this 2 year scammer shoves the paperwork under your nose over and over and over. Once you carelessly sign the paperwork with the "as is" embedded somewhere in the fine print you are stuck and you torpedo'ed your insurance company from helping you.

Since he took 2 plus years to fix the car, he should not expect you to instantly sign the paperwork with "AS IS" clause in just 2 minutes. The insurance agent can give you advice to sign or not.

Flash rusting is a thing. Happened to me when I soaked and pressure washed the cylinder heads during a full rebuild. The few seconds after I wiped the iron heads down and air blasted them dry, they started rusting. There was a few hokey pokey moments with a can of WD-40 and the air hose.

You will follow him in your car to make sure he actually gets on the freeway or does a real drive test at different speeds. That makes sure he doesn't go around the block, park the car for 10 minutes, and then come back. A real test drive should be 10 minutes minimum.

Be ready after the test drive to inspect the car yourself. Look for liquids leaking. Immediately sniff the car for burning smell. Check dipstick for bubbles in oil (prolly coolant if bubbles). Have flashlight to shine behind the wheel when you peer behind the wheel to look for leaks from caliper area. A small mirror may be useful since the car is probably not up on a hoist.

I would feel nervous if he refused to take it on the freeway because he felt that was too risky for HIMself to do that. If he feels it is too risky to drive, then you should feel it is too risky for you to drive.

Do NOT sign papers unless you get a real idea it is properly tested. An easy going 35MPH drive around the block doesn't count. If it cannot go freeway speed and you see smoke coming out as you follow, then the engine is in trouble from all that sitting.

By the way, just in case he tries the excuse "it was leaking before the test" you can inspect the car before the test so that you can compare before and after if new leaks appear or a new burning smell occurs.

The insurance agent is probably telling this story all over the company about this new record time taken to do car repair. It probably holds the record at 2 years 4 weeks.
