Shouldn't the judge have dismissed the case on filing, as it's been settled in the same manner as any cell phone that might have been sued for ringing and being answered while driving?

I met an expat in Ecuador who left the country because some kid was skating on this guy's front steps, falls and breaks his arm, the mother then sues this guy because the kid got hurt on his property, despite the guy not even being home at the time. He just got a letter telling him his court date. She won the lawsuit, so instead of paying the fines he bought a plane ticket to South America and hasn't been back in 15 years. What guy.
