for example its perfectly legal to have a picture of a naked child just standing there, as there is no obvious sexualization going on in the picture. however take the same picture and add fishnet leggings and suddenly it becomes child porn as that kind of clothing can be legally seen as sexualizing.

twerking itself is obviously sexualized. it's not really policed because its popularity make it essentially impossible to police, and because policing it would mean convicting a child of an offense of a law that was designed to protect them. however if you get an adult going around soliciting for children to twerk for them over the internet, that is easily punishable. but you're right in that it alone probably won't put you in prison, just in jail and on the sex offender registry.
