Yeah, does it have a model number inside on the label? Some Alvarez guitars don't have the name on the headstock. Yours looks like it could be older.

Clean it up, oil the fretboard and put some fresh strings on and play the fuck out of it.

a $40 guitar is a steal at any price

I have a cheap guitar like that. it gets used more than my good guitars because it sits in a shared workspace at my university. if it gets stolen or wrecked, no big deal.

It's almost certainly real. I don't know who would fake an Alvarez when you can fake a Martin or something. Some actually don't have the logo, or the strap button. It's probably a bit older, maybe from the 80s. $40 is nothing, if it is set up properly, it should play fine.
