Does that really mean anything though? Especially if they release it online at no cost? I mean I'm clearly no expert, but aren't copyright laws more lenient in Japan? Just look at doujins. Maybe the Japanese companies whose IP is used would be fine with it, but if the legal department of an international media empire like Disney or Paramount saw Gainax (or any entity with lots of money) doing current work on (and, I guess, therefore asserting ownership of) a widespread video that used their IP, I think the lawyers would sink in their teeth and never let go.

The current state of affairs is evidently fine, but I think that might have something to do with Gainax being officially created in 1984, while the openings are from 1981 and 1983.
