Just because morals are a social construct does not mean that they are not useful, or that there are no consequences for not following them. All restrictions should be scrutinised, yes, but they are not revoked. If the consensus is that rape should be punished, then rape is not permitted. If the consensus is that murdered should be punished, then murder is not permitted. It is only the processes by which we determine what is, and is not moral, i.e., what should, and should not be permitted, and how we go about enforcing the consensus reached that need be discussed here.
