For this to get overturned it actually has to be enforced on someone. I doubt that will actually happen and if it does that person will likely be either a) about to kill themselves b) charged with some other crime like domestic abuse.

A person would have to get their shit taken away and either damaged or not given back then there would be a cause of action. Then there would a be a claim against the government which would go into federal court as under U.S. v. MacDonald the right to bear arms is a fundamental right. Then you have to get a district judge that would agree that the right has been abused and not let the state win on some technicality (unlikely). Then it would have to go to the 9th Circuit Court and likely it would be held constitutional there since that court is fucking insane or the 9th would decided this really isn't a constitutional issue. I doubt the Supreme Court would take it after the 9th because a) they really hate fundamental rights cases b) there's no split in the circuit courts.

Basically it will just die in the federal court system but probably won't be abused because the state does face a risk of having this declared unconstitutional and all the fuckery that would bring.

Someone could also argue that the mechanism of the hearing is federally unconstitutional for lack of due process. I doubt that would go anywhere.

Judges are going to find it "highly probable" that something is going wrong simply because the person owns a deadly weapon. All the law enforce will have to do is make a decent argument with some evidence (like posts on a malaysian basket weaving forum) and boom no more guns.
