Hey /k/, I'm going to be buying a gun soon for home protection. But I'm afraid I might be denied on the background check. I have a misdemeanor for terroristic threatening 3rd degree. I was charged but not convicted, the charges were dismissed. I was reading online that charges being dismissed is the same as being not guilty.
So will I be okay if I go and try to buy a gun?
Should be fine.

Just buy privately.
No background check.

A charge being dismissed is not the same as being convicted. Dismissed means the state dropped it's charges.
I have the same shit from back in high school. You'll pass, it's not disqualifying.

>I was charged but not convicted
then you dont have a misdemeanor 3rd degree.
you are totally fine.

No it's retarded. But long story short, I was recorded threatening to beat someone's ass. But we made up and the charges were dismissed.

You'll be fine. NICS really only cares if you have any convictions, open cases (being in court for criminal charges), current active warrants, a history of being involuntarily institutionalized to a mental health facility and some other stuff I'm missing. Non conviction means no problem.
I was charged with malicious destruction of property, which is a felony, but it was all dropped to non conviction after I paid restitution and 6 months of probation. I've never had trouble buying guns and have a CC permit. Although my NICS checks take a few minutes longer than most people with zero criminal history and my CC permit had a slight delay on it, but still came in well within the time allotted by the state.
