This, of course was an absolutely ATROCIOUS idea, because you're bringing in lots of people of questionable character (various mental problems and shady motives), into a warzone, meaning not only will they get themselves or others killed, lose or steal equipment and material, but because they're fucked up people, they're rather likely to also engage in various delightful warcrimes, particularly from being fucked up by the shitty conditions of the Vietnam era US Military, the My Lai massacre for instance had numerous convict conscripts involved.
The reason Vietnam had an unusually high death toll for the US is more than likely because you had all these convicts dying in various horrible and probably otherwise preventable ways, not JUST because fighting a guerilla sucks.

But I wouldn't call it a military defeat on the American's part though, they really were pounding the NVA pretty damn hard by the end, it's just by this time, politics at home made the entire thing fall apart and the people were demanding they pull out of the war and come home, whether or not you feel that is right is another story, but keep in mind a lot of people got a first proper view of how ugly war could get thanks to TV and the press, and Vietnam was a *particularly* ugly war, the American people felt they wanted no part in it.

After the Americans left, there really just wasn't anyone to oppose the NVA anymore, and the country was just steamrolled in short order, becoming a Communist state. A horrible war that wasn't really good for anything, it might as well have not even happened as far as the end results are concerned.
