>Sep 01, 2016
>A federal judge just upheld a ban on gun sales to medical marijuana users, forcing possibly thousands of Arizonans to choose which they want more.
>On Wednesday, it was decided in 9th U.S. Circuit Court of Appeals that anyone with a state-issued medical marijuana card, even if they do not use it, cannot buy a gun.
>>
>>33858195

You can own them just not buy from a ffl.

>>
>>33858025
>Private sale is perfectly legal.

In 99% of cases, no one is going to stop you, but that doesn't mean it's any more legal to buy a gun through a private sale if you're a marijuana user. It's the same as how felons might want to buy through a private sale to get a gun; illegal, but without a background check (or registry), no one is going to be able to stop it from happening. If you are a Prohibited Person - and you are if you use marijuana - then it is illegal for you to buy or own guns, period.

>>33858225
You can't own them, receive them as gifts, trade your lawnmower for them, or even hold onto them for a friend. It's not a technicality unique to Arizona. It's a matter of federal law. In some states, the owning part is enforced; in other states, it isn't enforced actively, but if you're caught with a gun as a Prohibited Person, that's an automatic up to 10 years additional to your sentence and up to a $250,000 fine.

>The Gun Control Act (GCA), codified at 18 U.S.C. § 922(g), makes it unlawful for certain categories of persons to ship, transport, receive, or possess firearms or ammunition, to include any person:
>who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act, codified at 21 U.S.C. § 802);

And before you start your predictable temper tantrum about muh states' rights, note that "controlled substance" is defined by federal - not state - law. And yes, marijuana is included under the purview of this legislation.

Im not against it because its illegal, I'm against it because it turns good honest people into lazy shitstains that vote pro socialist. only useless fucks want everyone else to take care of them. So again, grow the fuck up, and learn some accountability.
>>
>>33858307
Eh well medical and recreational is illegal under federal law. So either way your committing a federal felony. But fuck the government, when it comes to shit like that. Living in fear isnt living.

>>33858025
>make it incredibly inconvinent and illegal to own firearms, risking a felony conviction

If you've resigned yourself to breaking the law just to live the way you want to live, then why move to Arizona at all? I assume that's what this conversation is about, right? Moving to this state, rather than staying where you are and owning guns/weed?
>>
>>33858393
Nah man, born and raised here. I find people here tend to leave you alone if you pay you taxes and have legitimate income. All bullshit aside, the atf will only fuck with you here if you sell illegal merchandise.

>>
>>33858355

What's the point of owning firearms then if you can't use them for self defence? If Arizona has legal CC, you automatically can't do that if you have a weed card, because you're not supposed to have it in the first place.
>>
>>33857596
Unless it's done on a federal level legalizing weed state by state will ruin your state.

I live in Colorado and since it was made legal absolute burn outs have been moving here, the population is getting ridiculous, housing prices are sky rocketing, and all of these pot heads come here and vote anti gun laws into place.

It attracts the wrong kind of people. Some of these assholes move here with no plan or job in place and now pan handlers are a regular sight. I fucking hate legalized marijuana.
>>
>>33858418

It's a mark of your immaturity that you think you're immune from the law. Just off the top of my head....

>pulled over for traffic violation when you have weapons in your car, the cop investigates and finds out you have a medical marijuana card, takes you straight to jail

>burglar breaks into your house while you're at home, you use a gun to scare him off, when cops investigate they find you have a medical marijuana card, take you straight to jail

>driving to the range and someone matching your description has committed a crime nearby, a cop pulls you over and tries to identify you, finds you have a medical marijuana card and a gun bag plainly visible in your back seat, takes you straight to jail

>local gun store/shooting range that you use is audited and the ATF takes the range attendance records or 4473 records, finds your name, cross-references with medical marijuana database, break down your door at 3 am, kill your dog and take you straight to jail

Tell me more about how you are above the law.

How would he find out about my medical records ? Are you that daft?
>>
I'll stick with Pennsylvania thanks.
>>
>>33858561
would you rather
A) Smoke weed "legally" at the cost of legal firearm ownership and the risk of years in the slammer for using it in self defence
B) not do that, smoke weed illegally as it is now, at the cost of it being slightly more inconvenient to get weed, with the only risk being a misdemeanour.
>>
>>33858651
>Are you that daft?

A very basic google search shows that I'm right.
https://www.theweedblog.com/can-law-enforcement-access-a-medical-marijuana-patients-records/
>>
>>33858651
And even if they didn't search for your name on the medical marijuana registry first, if they smell weed at all (very likely since you're probably smoking it every day), then they are going to want to know why they smell that. Your options would then boil down to a) show your card to prove that you are permitted by the state to be stoned, or b) go to jail.
>>
>>33858676
>smoke weed illegally as it is now, at the cost of it being slightly more inconvenient to get weed, with the only risk being a misdemeanour.

It may be a misdemeanor for possession of weed, but it would still be a felony for possession of a gun while being a marijuana user.
>>
Kentucky is okay if you can deal with humidity.

Still no constitutional carry though.
>>
>>33858710
So? It's going to be a felony getting a marijuana card and owning a gun anyway. Without the card, the odds are significantly less of you getting caught with weed and a gun than you having a card and getting caught with a gun alone.
>>
>>33858697
What if sombody in the the residence or car can legaly have firearms?
>>
>>33857930
Well maybe if the hard working people didn't have to pay taxes to support those lazy individuals, you wouldn't have to give a shit.
>>
>>33858765
What if my aunt had balls? The point I'm making isn't to rank each situation in terms of likelihood, but rather to point out that there are quite a few, very real situations that you can find yourself in, in life, in which a cop can get suspicious about your owning guns and weed.

It doesn't say it anywhere. But the federal government has no authority over intrastate drug use, production, and sale. The commerce clause is the most thinly stretched legal hocus pocus in the history of democracy.
