It is a war crime to fight without uniform, and as such, insurgents aren't protected under the Geneva convention.

When the leaders of a state declare war on an other state - or hell, even on just a person like Osama - they send their state sanctioned, uniformed, regular army after you (and probably some mercenaries too these days).

When the people of a country have had enough of your shit, they will fight you as guerrillas and irregular forces. If you don't want to face insurgencies or partisans, then don't piss off groups of regular people. *shrug*

But many do actually wear uniforms of some kind anyway. Look at ISIS or FARC, they love wearing uniforms. Even the French Resistance had their berets!

The problem is, foreign soldiers entering an area and being unfamiliar with the culture, so not being able to pick up on the clues of what's unusual in the way someone is dressing, walking, talking, etc. especially if they're not carrying an AK or RPG at that exact moment in time.

Just imagine a Pashtun being magically transported to Germany, they wouldn't know the telltale signs of an Antifa guy on the way to a protest either.

Firstly, guerilla/insurgency/asymmetrical warfare is the most common type of conflict throughout world History.
The USA would not exist without insurgency warfare (utilized by the colonial americans).
You may as well be arguing for each side to have a 1 on 1 duel with champions to decide the victor.
