Has anyone here ever failed the NICS background check when filling out a 4473? What happened? Did the seller just tell you to leave? Anyone have any interesting stories about watching/listening to people who failed the check?
>>
Not a felon or nigger, never happened to me.
>>
>>31652046
I saw this one dude get denied when trying to reclaim his pistol from pawning it. He was pissed, got loud, told to leave, broke the counter, cops called, he left. Dunno how it all turned out, but always wondered how that should have worked. I guess consignment sale?
>>
>>31652046
I fail everytime because Im a felon. I have to get the transaction ID and appeal it to get ok'd.
>>
I was visiting relatives in Arizona. He was go I to buy me a rifle. Got put on a 5 day hold.

I was only in town for 3 more days. When I asked why the dealer just shrugged and said it happens to cops all the time.
>>

*my uncle was going to buy me

>>
>>31652090
yeah, i work at a store and unfortunately it happens all the damn time, and nothing we can do about it. Even having a name thats similar to someone even the slightest bit shady can get you a delay.

A friend of mine hadn't ever bought a gun from an actual store before, and when he was 22 he tried to buy a Glock 19 at the local Gander Mountain. While filling out the paperwork, he had a brainfart and thought the "have you ever been convicted of a felony" question actually meant "have you ever been to jail", and he checked 'Yes' in the box, as he had been to jail for a PoM charge before. The guy behind the counter looked over the paperwork and said "sorry man, I can't sell you any of our firearms or ammo today, but you're more than welcome to take a look at some of our other defense products", so he asked why and the guy explained that the questionnaire paperwork didn't meet the eligibility requirements, so my friend just left and was kinda embarrassed about it. He was a lot more embarrassed later when he told me and I explained to him the difference between serving months in prison for a felony and sitting in the county jail for 3 days and paying a $150 fine.
>>
>>31652162
Do you ever call the police on people, or do you not get that kind of info. Let's say a guy with a warrant for murder tries to buy a gun, when the seller calls the NICS office, do they tell him that the buyer has a warrant, or just to deny the sale?
>>
>>31652196
Not him, but it's generally

GO AHEAD
DELAY
DENIED

They don't get into specifics.
>>
On phone fuck meme arrows

Be me
Have pretty unique name
Go to new shop
See pretty lil thang
Decide to buy
Fill out form
Don't put my social as I usually don't need to
Guy runs it and it comes back as a decline
"Sorry but we're not gonna be able to sell you anything, but hey it could be an error or maybe they think your address or social is wrong"
Have them run it again with my social
Comes back clean and I walk away with a 686+
>>
>>31652165
>felony
>months

Felonies generally involve more than a year time if not falling under any plea bargain deal bullshit.
>>
>>31652331
Is "delay" almost always "no" or is it a mixed bag?
>>
>>31652351
It's usually "probably a pass but we need more time to make sure this guy isn't this other felon with a name that's spelled the same but lives three counties over"
>>
>>31652342
I know it's usually years but I specified months because I know people who have only gotten 16-20 months for some felonies and I didn't want to basically say that all felonies = multiple years. Either way, 10 years is still 120 months, but 3 days will always just be 3 days.
>>
>>31652385
I get what you're saying, but six months isn't always a felony.

Simpler way to put it is county jail usually doesn't have felons serving time, that's state/federal penitentiary territory.
>>
>>31652046
I went to purchase a pistol on y 21st birthday and got denied. Later that week I gots teh all-cleeeer from another LGS. After I got my carry permit I went back and laughed over what happened but the faes of the employees that day were of pure disgust.
>>
>>31652461
>they were of pure disgust
Wut?
>>
>>31652487
The employees were this fudd/tacticool hybrid. They just looked up at me with this felon-plz-go kinda look and said "You're red flagged, kiddo. No sale." When I asked them to explain the procedure they literally would only reply "Call NICS."
>>
>>31652385
The whole concept of a felony has been so fucked up by our lawmakers

Any crime punishable by less than 10 years in jail has no business being called a felony.
>>
>>31652573
can't you get a felony for doing the most mundane shit nowadays like farting sideways in the opposite direction of your turn signal
>>
>>31652592
You can get felony child porn charges by having your 17 yr old girlfriend a day from her birthday send you some lewd pics.

Even if its legal to bone her in your state.
>>
>>31652573
I had a first offender felony and still have my gun rights. It was the most remedial shit, too. I served nine months time and have a CWL. Based Georgia, man.
>>
I don't know whether I failed the NICS check recently or not. At Rural King their new shit ass system auto rejected me even though all my info was correct. They wouldn't even sell me the ammo I was going to buy. They refused to give me the old paper form and just call it in.

I left their shit ass store and went to a real gun store. 4473 passed no issue.

Fuck Rural King.
>>
>>31652592
I did 7 days in jail for a DUI. But there were guys facing prison time for 7th and 8 offense DUI's.

The thing is guys always fuck up their probation. Jail sucked, but I talked to a lot of felons. I can't complain most were friendly with me, and again only 7 days.
>>
>>31652046
With delays/denieds you just get turned away. If you want you can file an appeal with the FBI NICS.

Had it happen a couple times as a LGS salesman.
>>
>>31652631
What did you do?
>>
>>31652709
I am very ashamed of it, but I actually stole a firearm from an unlocked vehicle. Hate me.
>>
>>31652767
Damn anon, why'd you do it
>>
>>31652767
You did your time
>>
i have a friend who gets a delay every single time because he was charged with beating the crap out of his girlfriend, who then decided it was too much effort to keep lying about it and dropped the charges. he still has to wait three days for it to time out even though the case never went anywhere and charges were dropped.
>>
>>31652809
You would think that by now they would stop delaying that shit. Guess nobody cares enough in the FBI.
>>
>>31652782
>>31652794
I was young and I live in a town called Senoia, Georgia. Which is a backwoods shithole. We all drank and rode fourwheelers religiously despite being antiredneck. One night a kid who we didnt even like that much just kept bragging about his moms smitty that she left in her car. We originally were just going to borrow it...But we wanted to be 2kool4skool hasguns.
>>
>>31652837
Ahh gotcha.
>>
>>31652837
So stealing a firearm is punishable to 10 years?

That seems drastic. What if you just stole $500.
>>
>>31652885
Minor in posession of a firearm + entering an auto with intent to commit theft.
>>
>>31652905
Well, glad you made it through.
>>
>>31652905
Shit dude. That doesn't deserve a 10 year sentence. Kids do stupid shit.
>>
>>31652885
What is absolutely fucking hilarious to e is that there were three of us involved. When my closer friend and I were pulled over with the stolen fireaarm we immediately came clean. Our other friend who is black served two years with no priors, while friend 1 and myself were hit with 9mos. Which boiled down to 180 days or so. It's actually pretty fucked up, but definitely still funny...
>>
>>31652944
Looking back on it...yeah. Kids do stupid stuff. And that was our slogan in court. But people in general understand that you shouldn't steal. Children, let alone 15year olds in general grasp the concept to not take peoples shit. Especially shit they shouldn't have ie guns. I did a no no. And I really got a slap on the wrist. I could've killed myself, or my nigger friend. Or even my white friend. But it really scared me straight.

you can appeal if your a felon? hows that work?
>>
I'd typically get a Delayed till the following day when I was on a H1-B visa. Since I became a citizen they all go right through.
>>
I was once charged with a felony, that got dropped down to a misdemeanor, then got a DUI a year later. After i was off probation for that i went to buy a firearm and got delayed. They called 3 days later with the go ahead. Got my CCW with no issue, then delayed again the next time i bought a firearm but got the go ahead a few days later. In my case I think the felony charge throws a huge red flag and they need to dig deeper to see that it was reduced. I got a second DUI since then and am waiting to be off probation before I carry again or attempt to purchase another firearm, or go to the range.

I am glad I didn't lose my rights completely. Shit sucks but I deserved what I got for what I did. 6 months clean, I enjoy this way of living.
>>
ATF/FBI doesnt process appeals to denials anymore, if you get denied your a prohibited person.
>>
I had a delay once. It weirded me out.
Got a call around an hour later telling me that my sale was approved.
>>
If you were committed a crime that could carry a punishment of 1 year in prison or more, you'll be denied and will have to appeal it. Once you get denied, you're a prohibited person and cannot legally own any firearms, firearms parts or ammunition. If you get put into delayed/research it'll usually be approved within a few days and you'll never really know why it wasn't instant. If you're denied, the gun store will never know why unless they can look you up in the public court records
>>
>>31652196
we dont get that info. at all.
we get, like the other anon said
approved
denied
delayed

i suppose if we somehow figured out the guy had a warrant out we would contact police, but i don't see how we would find that out during a sale.

occasionally we will fake a "delay" if the customer is exhibiting VERY suspicious behavior (saying or mentioning to a friend "i'm gonna get that cunt" in earshot, shit like that), but it is an extreme and incredibly rare case.
>>
>>31652046
>at gun store
>getting check for p226

>the fuck
>5 mins later get cleared

that was the worst that ever happened.
>>
>>31653423
Not him, but only certain felonies permanently disqualify you from gun ownership
>>
I was delayed on like my first 10 guns I purchased and then all the sudden I started getting approved immediately. I think they just wanted me to prove I was serious.
>>
>>31652351
actually, generally they're proceeded or "no resolution" which means they didn't deny within the 7 days so the customer can get their gun. but we're a fairly small shop so it could just be a regional anomaly.
>>
>>31654219
Proud of you for being clean, but drunk driving is pretty low. I hope you keep your head on straight from now on, anon.
>>
I just moved and updated my address with the DMV, do I need an actual new license, too, in order to buy a firearm? Or will my background check pass anyway? I have never been delayed before - in fact the guys at the shop thought I must have some sort of security clearance because my checks come back almost instantaneously.
>>
>>31654628
you need a valid government-issued photo ID with your current address. An update card or government mail to your new address, in addition to your valid DL will work
>>
>>31652351
In a decent shop, almost every 4473 ends with the buyer getting their gun. That's because prohibited persons don't bother with legal gun purchases.

However, in a chain store, if the FBI delays it and never gets you an answer, the store often won't release the firearm.
>>
>>31654417
>Once you get denied, you're a prohibited person and cannot legally own any firearms, firearms parts or ammunition
Flat out wrong.
>>
>>31654577
Thank you, I'm much happier now. I'm very ashamed of what I did, but also grateful the only person I hurt was myself. Am taking the necessary action to keep my damn head straight from now on.
>>
>>31654740
yeah I was a little retarded there. My state has it's own background check system, we don't use NICS. Which doesn't change anything, but what I mean is that if you're a prohibited person, you cannot own those items. The act of being denied by the background check isn't the thing that makes you prohibited though and there are wrongful denials all the time
>>
>>31652077
do y'all think someone like that should be allowed to own a gun? sounds like if they had one they'd go nuts with it and cap some people, so if they should be allowed one, how could people be safe from a violent, quick to anger person like that?

I don't really have an opinion, just curious.
>>
>>31652351
I get delayed every time, and EVERY SINGLE TIME, I drive home and get a call from the shop telling me that I passed and can pick it up asap. I've started just waiting inside the shop for half an hour while the delay gets dealt with.
>>
>>31652341
This happens sometime when you get a shitty NICS examiner.
>>
I am finding more and more customers are getting denied not for felonies but violent misdemeanors now.

Unfortunately they shut down NICS Appeals indefinitely so the only way to Appeal it is getting an expensive lawyer on your side to Appeal by lawsuit.

He ended up getting a UPIN and now passes every time after a short delay.

Worked in a gun shop for over a year. Three possible outcomes:

Proceed
Deny
Delay

Delays are usually the FBI's way of saying "we need to look further into their background" but that doesn't always hold true. If you have a generic name and there's a million other John Smiths out there, that could do it. Or maybe they're all on their lunch break or NICS is just acting up, they can delay for whatever. It happens to a shit ton of people with almost no explanation and it doesn't matter the details, so don't sweat it if it happens to you. They have 5 business days to get back to you and if not you can transfer the firearm anyway. In my experience, they rarely got back to you before then.

Another thing is they can deny you for whatever they want. Acting like an asshole, smell like weed, race, creed, religion, whatever. They don't have to sell you a gun period.

When someone was denied or delayed, we just explained to them what happened and if they felt unjust the can appeal it online or apply for a UPIN number. That's pretty much it, lot of anger and embarrassment but never anyone freak out or anything.
>>
>>31652653
The only proper way to get back at them is to go there at their peak business hour and scream RURAL KING HAS RATS as loud as you can before running out.
>>
I knew a guy that used to have to put his SSN because he had the same name as his father who had some issue with the ATF years past. Funny enough, now the guy I knew is in jail himself (deservedly so) so he won't need to worry about that anymore.
>>
>>31652046

>Squeaky clean record.
>Work in public safety.
>Background checks performed quarterly for driving.
>Criminal performed bi-annual for work due to nature of job and fact that I have access to narcotics

Never had a problem as a firefighter/Paramedic, until.

>Attend State Patrol sponsored program
>3 months long
>Background checks every 5 days
>Ran our tabs every time our vehicle entered and exited the facility

Ever since I have flagged as delayed on handguns and had to wait it out. FFL says its not uncommon for those with security clearances and or a shit ton of background checks to pop as "review" as they want to know why someone was looking at you in such detail.

Don't know if it is coincidence or not.

Ofc my name is a bit on the common side so
>>
>>31653423
Some states give you your gun rights back.
The feds say that if your state has given your rights back then they are ok if you get a gun.
>>
I got denied the first time I tried to buy a gun because apparently I have the same name and birthday (but 30 years later) as some IRA scumfuck terrorist.
I had to call NICS, prove that I wasn't who they thought I was (which was surprisingly hard considering I have never even been to Ireland, let alone bombed a bus there), who then mailed me a signed document that I have to show whenever I get a background check. What happens now is they will submit the check, if they do it online then a few minutes later they will get a call from NICS asking them for a confirmation number that is on the printed document that I brought with me. The clerk will give them that info then NICS will give them the go-ahead and the NICS transaction number and all that bullshit.
Also, that terrorist is dead now, but I still have to have that paper.
>>
>>31652046
>Has anyone here ever failed the NICS background check when filling out a 4473?

I was buying a Yugo Mauser from Dunham’s Sporting Goods years back (for $89) and the NICS check failed me for some reason. Told the kid running the gun counter that it was fine and happens sometimes and that I’d just come back the next day.

When I came back the next day, the kid was all worried about running the NICS check again;

ME: “Hay kid, I’m here for my Yugo Mauser, rerun that NICS check.”
KID: “Umm… I dunno if that’s legal?”
ME: “Sure it is, sometimes the system has a hiccup for one reason or another.”
KID: “Yeah, but…”
ME: “Either you can rerun it or your manager can do it.”
KID: “Well, ok… Hay, it worked!”
ME: “Great, now walk it up to the cash register, incase I have a flash back to Battle of Sutjeska.
KID: “Wut?”
ME: “Forget it…”

Voluntary means you know you have an issue, and you're either solving it, or you've solved it. Involuntary means you either weren't aware you had one even though it was obvious, or you were aware of it, and deemed to dangerous to society in your current state.

Voluntary is fine, a lot of people have some issues, involuntary means something is really wrong with you.
>>

The day I turned 18 the family took me to the LGS that we've purchased from on the reg. When doing my first 4473, the guy comes back and says, "Kid, I don't know what you did, and I don't want to know, but they said to keep you here for the next ten minutes."

Then he busted out laughing with a shit eating grin and gave me my Nugget.
>>
>>31655723

Involuntary means you were compelled by force of law against your will into a confined hospital setting - usually, but not always, because a judge felt your behavior was sufficiently dangerous to warrant the confinement.

In some states, you can lose your gun rights for life, as a juvenile, just for saying something dumb and having someone call the cops.

In some states, even voluntary commitment will result, effectively, in the loss of your rights for life - but in some cases this can be avoided if you carefully research the circumstances of your past and are aware of what records are kept and by whom.

Wisconsinfag here. Used to have a 2 day wait period for handguns that was legislated out of existence last year. Bought a pistol at Cabela's 2 weeks before Christmas. Store was busy as fuck. About 30 people waiting on background checks, getting delayed left and right because the system was so swamped.

MFW I was approved immediately and walked out before dozens of people who had been waiting for like 2 hours. They were so pissed at me.
>>
I've bought 3 guns, and had 3 delays, lets discuss those:
>Mossberg .22
First gun, went in to Dicks, got delayed, "we'll call you". I call back after 4 days, nothing has come in. Call back after a week, it came back, I'm good to go.
>Mossberg 500
At Dick's again, want to buy very nice Mossberg 500 with ghost rings and heat shield, get fucking delayed again. They call me after 3 days, go in to get it. Kid at the counter tells me that everyone for the last 3 days got delayed because somehow Dicks' system was fucked and couldn't return Proceeds, only delays. It took them three fucking days to realize that the 10+ delays with 0 proceeds weren't a coincidence.
>Mosin
Buy glorious 1943 blond Mosin at gun show. Check doesn't come back, poor guy selling it to me has to sit with the phone to his ear for over an hour waiting while I meander around waiting for it to come back. Finally leave because fuck waiting around more, NY gunshows are gay anyways. Get a call an hour later, it cleared. Get to drive across the city again to go get it.
Moral of the story: fuck Dick's Sporting Goods, BTW they also won't sell to you if it doesn't come back within 5 days, it must come back as a proceed.
>>
>Be me

>>>try to hack me
>I have a common name and every time I do a background check something comes up. Probably just because they have to sort thru a billion Tom Smith's

I had a hit pop up on a background check (not for guns) due to something like that.

I had an absurd number of family members die in a very short span and sought grief counseling on my own accord.

Learned some productive coping mechanisms and quit going after 3 months with a clean bill of health from the shrink.

6 years later I interviewed for a security company and it was this HUUUUGE deal that I had witheld "PSYCHIATRIC TREATMENT!!!" on my application.

I was never even medicated, I just spoke to a professional a few times on my own accord, then went on my way.

Luckily I kept the paperwork and was able to explain well enough to be hired.

But yeah, peolke just see anything attached to the word "psychiatric" and automatically assume you must be the next jeffery dahlmer or some shit.
>>
>>31652046
My father missed checked the dishonorable discharge as a yes because he miss read it. The guy behind the counter said he couldn't sell him a gun, but, he could come back in about 2 days and try again.
>>
>>31652162
That's not an issue with NICS, it's actually a problem with states like Arizona that refuse to use NICS, and instead require private initiation with the FBI.
>>
My friend was on probation for a year for paraphernalia. Went in to buy a gun and got denied. He asked why and told the clerk that he was on probation.

I laughed pretty hard when he told me about it. He was embarrassed and said everyone was looking at him. Personally, I don't think he should be allowed to buy one. He's irresponsible and almost shot my eye out with an airsoft gun.
