What stops people from the other countries from being nice and helping people?

The difference is we don't brag about being nice or helping people in need because it's a part of decent behaviour, while social trust in USA is so low that such acts are seen as out of this world. How could anyone possibly thinking helping someone that isn't their own family? Objectively, no.

Using a subjective test still requires evidence that the defendant demonstrate that they thought it was reasonable. It's not a get-out-of-jail-free card.

An objective test means a court has to prosecute the most pitiful, defenceless victim in the most borderline cases.

The people in the planes that crashed into the buildings thought the terrorists were going to land somewhere to get their demands met, they didn't know the plane would be used against a building.
