From my experience (was actually detained for something like this) it's pretty much there so that if you're doing something shady but not illegal they can bring you in and find out what's going on.
The fact that they're actually planning on putting him away for 5 years over this and nothing else 'to send a message' is unbelievably shitty and I expect nothing else from Virginia police.
