The whole penal system in the UK changed for that very purpose. People were being arrested and sentenced to being sent to the Isle of the Bold for the most trivial crimes, crimes they weren't even aware they were committing. Rapists and murderers were given the death penalty instead.

Australia was never a penal colony, it was simply a British experiment that turned out to be a success. It was predestined to be a legit British colony from the beginning, and not only a British colony, but the best British colony the UK could ever found.

Also, another detail I forgot to mention is that the convicts were sent to Australia together with their families. They served their petty sentence and then were given instructions by the British government to colonize Australia. It was all part of their Eternal Anglo masterplan after all.
