No, a volunteer division does not mean officially joining. Franco was very sympathetic to the axis and Hitler tried convincing him to join and ended up hating him but Spain was neutral and because of the civil war wasn't able to join and be effective.

Regarding civil rights in the republic, they were severely breached, the Red Terror didn't start with the war. There were left wing coups. There was violence by the state itself and violence that the state allowed. Priests, politicians, dissidents were killed. A communist revolution threatened the country.
