YOu do realize that bench trials are a thing? Are in fact quite common in civil trials, which are enormously more common than criminal trials? And that even before you get to trial, you have an enormously long and complicated pre-trial setup about what you can and can't bring in trial? Don't let TV fool you, those motions are where the battle is won or lost, 99.9% of all trials are foregone conclusions.
