The Reichstag fire occurred after Hindenburg appointed him Chancellor. The fire was excuse to enact the enabling act which led to the dictatorship. Hitler won the election by itself, but yeah, if the other parties wern't being shitheads they could have blocked it, but they didn't and Hindenburg had no other choice. German federal democracy was young and untested.
Honestly the Germans should have been allowed to reform their government under British style parliamentary system with the Kaiser as a symbolic head of power (as long as it was Willy's son as the new Kaiser.) Having the old tradiitions would be a significant reminder of their past. Wiemar was untested waters.
