The thing about constitutions is that they are a fundamental aspect of common law. What people don't understand when they say stupid things like "we need tuh git back too duh constuhtooshun" is that, being a document of common law, the Constitution was made to be flexible and elastic. It was altered ten times before it was even completely ratified.

The Constitution has already turned into a document that I would not fight to protect. But I see the oath to defend the Constitution as more an oath to defend the people that the Constitution was written to govern. If it became necessary to disregard the Constitution to protect the people, I would. If it became necessary to disregard the government that the Constitution created to protect the people, I would.
