The problem with that xkcd is that freedom of speech is extremely limited as a tool for reaching the representative consensus. It's not relevant in at least two common situations:
a) when you're the minority and those who want listen to you just can't, either because of self-thought-policing or because the opposite majority is too loud for your voice to be heard at all.
b) when several groups isolate themselves in their bubbles, refusing to listen to others they disagree with. Which is natural to human psychology.
Both of these can't be solved legally at all. You can't force anyone to listen. It can be solved only through culture. The practice of limiting discussions to a certain idiomatic language subset (just like in my post) is really counterproductive to this, even in small quantities. It doesn't have to be enforced for eveyone to be harmful.
