ARM is also closed and proprietary.
Emulation and emulators have gone to court and won basically 100% of the time. I don't think Intel will actually pursue this it looks more like a way to discourage other manufacturers from doing the same.

Only against systems integrators using other companies' CPUs. Nintendo can't prevent anyone implemented 6502 CPUs because they don't have patents on 6502. Intel does have patents on parts of x86.
