You shouldn't give in your notice until you sign a contract with a new employer.
That said, if you have signed a contract with your new employer, you may be entitled to go after them (a contract is between 2 parties, so they have to hold up their end) unless they have it in the contract that they can cancel before commencement.
Also depeneds on the law where you live
