I didn't know about the hash value stuff - that changes my perspective. yet, I feel this is something that can be abused on cases that aren't as clear cut as this one.

Let's rephrase that: There is evidence he has CP through his sister's testimony and proof he downloaded CP.

So there is beyond a reasonable doubt he has possession of CP, though I don't know if the laws he's subject to require the data to convict... probably not.

At any rate, he doesn't have to prove anything, he only needs to refute the evidence. And he probably only has more incriminating material on his hard disks since he isn't using it to refute the evidence against him.

In all reality, he is probably going to be jailed for awhile, until his lawyer can appeal on a technicality (for example, evidence obtained without a warrant or misconduct in court proceedings), find evidence that refutes the other evidence, or gets released on parole.

If the court can prove he probably has the files they can issue a search warrant. The issue at hand is whether it's like your house (you have to allow police to search it with a proper warrant, even if that means giving them your keys) or whether it should be treated as a self incriminating statement (thus protected by the 5th)
