no, but it's still prosecutable
if it's passworded, and you're not authorized by whatever entity set the password (rather than the physical device wrongly authorizing you), you most likely going beyond your rights by trying to enter a password

Linux administrator here. Social engineering is considered a legit form of hacking. Basically the lowest of lows. The top hackers are the ones who can code and run scripts via remote host machines.
