It doesn't matter. Your contract with your ISP includes clauses which say you'll use it appropriately. If you don't secure your WiFi and somebody else uses it, that is directly your fault and you are held to that contract.

It does get fuzzy when there are multiple people in the house, but the person the police will talk to first is the person who's name is on the contract.
