From a programming standpoint it's easily done if you have the system in place. For example, think of reverse image search. Or look at YouTube. Notice how when you upload a video it knows if it's copyrighted material, unless you heavily modify it which ruins the video, but makes it harder to analyze. They're getting better at that too though.

From a business standpoint it's suicide. Even with all the under the table money the government gives these companies, it's not worth it to this extent because they'll lose a majority of their customers. If not all, quite frankly. I'm not saying everyone is a criminal, but think about that time you downloaded a crack for a program or something that you later delete or whatever it may be.

It's also bad for them in general. Because while people care about privacy, they don't care enough to listen to freetards and install ganoo slash lihnux. However, if it comes to the point where they're analyzing your computer's content and actually arresting you... Then even the biggest Linux hater will move to it. This is the best marketing for Linux in years. Like how so many people went to Apple because of Windows Vista.

In short, easily done, but company suicide. I do mean company, by the way, not just Windows. No one will trust them.

If you upload stuff to MS's servers (using OneDrive, for example) then you can easily get busted for illegal content.
MS has automated mechanisms that detect certain stuff.

If you just use W10 with privacy settings at the lowest, then MS will still collect data about your usage (telemetry) that can be used against you, but it probably won't be enough to make a case on its own, you'll most likely need to be a suspect in the first place.

While this article debunked the common FUD it fails to address the big privacy issues:

1) Windows 10 is a cloud centric operating system that restricts user control over the updates installed on their machine, and it it has a EULA that gives them the legal right to change the EULA as they please at anytime; which you automatically consent to. Because of this, the design of the operating system itself not only could be an inherent risk in the future but if left with default settings it collects a lot of anonymized data about your usage. While people will claim, "well it is anonymized data so it isn't an issue" the reality is usage data can never be truly anonymized. Furthermore with this design Microsoft can be compelled legally to provide this data; which when enough of it is gathered, and when modern analytics are applied against it; it will become trivial to unmask the owner of the data.

2) If you choose to use onedrive your files are also automatically scanned against known illegal files. While not a real issue now if you aren't a criminal, who is to say the laws will be the same in the future? Items legal now could become illegal in the future, and then you are fucked.

3) Bitlocker by default sends your decryption key to Microsoft's servers unless you disable this option. Microsoft can be legally compelled to give this up.

4) It has a baked in advertising platform with a tracking id that is enabled by default for UWP applications.

Not him but the no games argument is not true anymore. Windows is the best os for gaming mostly due to most game developers are trained into developing for it with microsoft's closed APIs, so the simple process of porting a game that was developed for windows to any other platform will affect negatively the performance of the game. This with the fact that the marketshare is small compared to windows there's hardly an incentive at the moment to optimize for linux, making look as if the platform were worse for games than windows when in fact to flip the situation you'll need to change the idiosyncrasies on the industry itself.

The fact though is that the situation on linux is not nearly the same than two years ago and now those who prefer linux over windows now can play games on it, helping to break the vicious circle, but still there's a lot of things to do for linux to compete in the gaming side. I anyone wants for this to change i recommend to play the games you can on linux when possible and ask for linux ports.

I notice some people doesn't want's for this to happen but if that the case let me ask (not directed specifically to the person i'm replying): how are any of you benefited in a meaningful way with the current situation? because i consider that keeping the statu quo just to have a tool to win an argument on what OS is better is not a meaningful thing. how having less options and practically being locked to MS products benefits you?
