That is nearly impossible to police there are no borders online, so even if that data went to a European server it can easily be transferred from it to a US server.
Don't get me wrong, I don't like W10 that much and I haven't been using it, but if you're going to jump on a company, maybe you should come up with a better more well rounded reason and have full support of other agencies in Europe.
