Hasbro suing DC over the rights to use the Bumblebee name. Who do you got and why?

Interesting. Think they're gonna start pushing Bumblebee?
>>
>>94979250
how can they believe to own the name of a common animal?
>>
>>94979283

She's in Titans. I have no idea how she is on that DC kids show
>>
>>94979250

Hasbro would have to prove that they not only used the name first but also that people are confusing the two characters and that they have too much in common.

Good luck on that, Hasbro.

I hope this doesn't effect Bumblebee from not getting more toys from DC Superhero Girls. I like that she's finally getting merchandise. She was one of my favorite characters from the old Teen Titans cartoon.
>>
Well, let's get a quick google search going:

DC
>First appearance
>as Karen Beecher: Teen Titans #45 (December 1976)
>as Bumblebee: Teen Titans #48 (June 1977)

Hasbro
>First appearance
The Transformers, Episode #1 (September 17, 1984)

I want to see Hasbro lose this one, and then have DC come back and countersue so that Hasbro can't use the Bumblebee name anymore. >everyone taking this clickbait at face value
This lawsuit is in fears of losing the trademark in toys and has nothing to do with DC. Mattel has pulled this shit before on Hasbro where they will use a name long enough to snatch away rights from their competitor to ensure maximum profits. Hasbro won't even need to win this one so much as confirm that Superhero girls BB and TF BB are different things, once that's established that will undo any chance of a counter suit and ensure their copyright/trademark on the name Bubblebee goes unchallenged.
>>
>>94979941
It's a trademark case, not copyright. It's the exact same word.
>>
>>94980438
Yes in just toys and sports, they are trying to avoid what happen in 2000 where Mattel snatch exclusive rights to the word Hotrod for about 240 years because copyright and trademark laws are stupid.

>>
>>94980225
it's a little messier then that otherwise they would just use terms like "Autobot Hotrod" and "Autobot Bumblebee"
yes they lost the rights to bumblebee before
>"Bumblebee" was unavailable to Hasbro for many years. The name was being used as a registered trademark by a company called Playcore for their "Buzz the Bumble Bee" swing as of 2003, and as Hasbro had not used the name for a toy since 1995, their case to contest was likely a weak one. The Heroes of Cybertron PVC two-pack with Spike Witwicky was officially named "Autobot Espionage Team" for that reason, although the bio on the back of the packaging identified the two characters as "Bumblebee" and "Spike". Furthermore, as can be seen on the right, one of the main characters of the Armada franchise was initially intended to be named "Bumblebee" before the unavailability of the trademark resulted in the character being renamed into "Hot Shot". However, in March 2005, Hasbro tried to reclaim the trademark, due to its intended association with a principal character in the big-deal live-action movie and its associated merchandise planned across a great many categories. However, the registration attempt was contested in July 2005, both by a production company named "Bumble Bee Productions, Inc." and by an online toy retailer named "Bumblebee Toys", both of which argued that the mark, as it was filed under the "toys" field, was too close to their own registered marks. Ultimately, Hasbro abandoned the registration attempt for "Bumblebee" in 2006 and simply decided to use the name as a "normal", non-registered trademark instead. The movie's release date being pushed back a year meant that the first "Bumblebee"-branded Transformers toys in over a decade were a 3" Titanium Series figure and a toy from the Classics line. (Playcore, or more accurately, its subsidiary Swing-N-Slide no longer manufactures the "Buzz the Bumble Bee" swingset

This is not greed making them do this, it's fear.

It's acceptable for them to trademark the word "Bumblebee" in the context of being the name of a robot in a children's action series, anything further is a massive and immoral overreach and I sincerely hope you die for defending them.

no fucking shit they didn't because trademark works completely different with comic and TV materials. It's in it's own world, if you had any brain power you would have figured out this is because there is a toy that was made with the name trademark that isn't theirs and they fear losing the rights again because trademark law is a bitch.

Not true. They only have to prove that they already have the copyright and trademark. Which they do.

Right actually. Copyright is based on marketing, if you haven't consistently released a product with the moniker then you can't claim the rights over a company that has
>>
>>94981647
Trademark law is funny, you can't go in saying your intent is to secure the rights because that turns it into a hairy mess of every toy company pouring in to want a piece of that battle, however arguing that it's hurting a market you own is completely fine and it's a safe bet that with suit will end with just some assurance that SHG BB has to add a suffix or something to it.

That depends, did DC do a Bumblebee comic prior to Transformers starting up? And I don't mean appearances in the Titans, I mean a comic titled Bumblebee. Cause if they didn't it would end up similar with Captain Marvel/Shazam.

The only DC toyline I can think of after NTT started up in the 80's was Super Powers and she didn't get a toy there. The Teen Titans toy did get released in 2005 (and on the package she was called "Bumble Bee") and that was the year when Hasbro still didn't have Bumblebee trademark yet. How often did DC use her for merchandise between the Teen Titans figure and DC Superhero Girls? If they used the name semi-regularly they'd have a strong case. But a long period of time and it'd be an issue like how Hasbro didn't use the name Bumblebee for a long time (early 90's) and found it hard to attain for a while (they tried getting it in the early 00's but couldn't until like before 2007).

In a better world Hasbro would get their shit pushed in for doing such a thing, especially after they only barely got the Bumblebee name back in the first place. And no, bumblebee is't some super important transformer that can't be replaced. I was born in 92 and he was basically non-existent for most of my cognizant life until the middle of high school. Hasbro had cheetor and Sideburn and Hot Shot and other characters to fill the roll. Hasbro doens't even know what to do with Bumblebee. The Movie Bee is popular, but HAsbro tries to combine him with the G1 Bumblbee who isn't relevant to anyone under the age of 35.

Feel free to disagree with me, but the fact that Bumblebee is basically just Wasp-lite is just lame. The fact that she has wings and can shrink is just too similar for my taste. I know Marvel and DC rip each other off all the time, but don't you think a small alteration is in order, or dont you care?
>>
>>94984967
They didn't even file it until DCSHG was announced. It is specifically for toys though.
>>
>>94985005
I don't really care. The personalities are different enough as are their roles in-universe.

There's like 50+ flying brick characters around. Why is shrinking bug themed girl a big deal to you?

Bumblebee's has a different personality than Wasp so that makes her a bit different.

except they did not use her at the time bumblebee was introduced, they did not use her long after until the teen titans young justice show popularized the character, they have a damn good case of trademark abandonment.

Hasbro owns the TRADEMARK to the Bumblebee name applied to toys. DC's Bumblebee was created first but Hasbro has the rights to use the name.

This has happened to Hasbro in the past. They had to rename "Hot Rod" to "Rodimus" for a while, and "Shockwave" had to be renamed "Shockblast" for a while because another company owned the trademark.

This suit is because if Hasbro doesn't protect their trademark they might lose it since it would be considered abandoned. What will probably happen is DC will have to use a modified name for their character, like how Hasbro's "Jazz" is now always "Autobot Jazz." So she would become "DC's Bumblebee" in toys.

You're talking about corporate culture though, I'm talking about the legal side of it. If they wanted to settle, couldn't they make a binding agreement to just share the trademark?
>>
>>94986991
No it was a sports equipment
Each department/market has a trademark system that is just to it, otherwise you reach a hellish nightmare of things like Life cereal and Life the board game fighting over who keeps their name.

Toys, traditional/board games, and sports all share the same trademark family.
>>
>>94987091

>>
>>94987276
ah! that was the only shockwave named product i knew of the time.
>>
>>94987121
Actually I was talking about the legal side of it. Any compromise could be used as ammo against you later and most companies would rather throw down and win or lose rather than have the stress of years later having the fight anyway because one side decided they wanted all that success your product is getting. That's the issue here, what you are asking is if you can trust humans to be civil and agreeable which is a big fat "no" because if they were you wouldn't need the laws in the first place.
>>
>>94987326
Actually they do and you see why if you read the thread and/or read up on what the court battle was about rather than trust the clickbait.

According to all known laws of aviation, there is no way a bee should be able to fly. Its wings are too small to get its fat little body off the ground. The bee, of course, flies anyway, because bees don't care what humans think is impossible.

True. DC had Karen as Bumblebee for maybe two years in the 70's, then she was retired and out of costume till Devin Grayson put her in the suit in the late 90's, and she didn't start showing up as a series regular again till the short-lived Giffen Doom Patrol in the 00's. Hasbro has a MUCH stronger claim to the copyright.
