Same as any other transaction, the kid provided a service(His time to hear the story), and his payment was a physical good(the seed), he was the rightful owner of that item and was assaulted to obtain it.

The city guidelines are merely that, guidelines, not laws. As the Onceler should still be the owner of that plot of land, or it's government property, then either way he was legally allowed to enter and leave it at his leisure so long as neither of those entities protested, and they did not. He crossed legally to provide a service in order to receive compensation in a state that he is a legal citizen of.

You seem to have missed the part where Once-ler arrived there as a colonist who basically picked the first spot he liked and built his dwelling there instead of securing the deed first and only going to expand his site after such survey.

Also, if you recall the original book, Once-ler's house is strongly implied to be the last surviving scrap of his dilapidated factory, whereas O'Hare's Thneedville is situated in a great distance from it.
