I don't think "I planted a camera in this 15-uyear-old's super hero costume; here's a picture of a man's face now arrest him" is sufficient evidence to arrest a guy, especially not when it's coming from a civilian who is a world-renowned computer expert with a record of not cooperating with government authorities, and also photoshop exists.

The real question is how did a Stark-owned business not notice or do anything about half a decade worth of alien tech and Stark WMD's getting stolen? After the first couple times those vehicles should have had a personal escort of Iron Legion drones, or hell, Tony or Rhodey themselves. Or hell, why not Vision? It's not like he has a personal life and he doesn't need sleep or rest, and once it became apparent that things were being stolen without breaking open the door or cutting through the walls, a guy who can phase through solid objects would be perfect to catch the thief.
