The Battle of New York was 8 years ago in the MCU canon. Peter has been operating as Spider-Man for less than a year. He would have had to have lost Uncle Ben in the interim between receiving his powers and deciding to become Spider-Man, or his need to overcompensate by always doing the right thing at the expense of his own happiness would make little sense. Also, if Uncle Ben died in the Battle of New York eight years ago, why would the then 7 year old Peter feel any guilt for being unable to save him? This theory doesn't hold up under any scrutiny.
