The merchandise rights to the FF are a bit fucky. No one knows what the exact situation is but basically Marvel's main merch department doesn't have full control over them. That's why you don't see them on T-shirts or posters anymore.

The FF being fucked in the comics is a result of this, because Ike and other executives don't want to be giving attention to things they can't make merch money off of. It's related to the situation with the movie rights, but only because it's likely that the rights complication has to do with Fox.

This was revealed by people back when Marvel's 2015 promotional poster came out, and we found out there was some sort of rights problem involving selling posters with FF characters on them.

You're asking in jest but there is a serious answer here: Marvel is required to make use of a title once every few years or else they lose exclusive rights to it. That's why they'd shit out a new "Defenders" book every few years with creative teams and rosters which they surely knew couldn't be sustainable, just to hold onto exclusive rights.

I fully expect in a few years we'll see a four-issue "Fantastic Four" series starring X23, some Hulk, some Ghost Rider and some Spider-character just to hold onto the rights.

I had this idea for while but if I where in charage of an F4 movie Id play it something like this

Movie opens with a Darwyne Cook style animation showing how they got their powers over the intro credits to get the origin out of the way in about a minute and half

From their the Fantastic Four are already celebrity science heroes and the film uses a reality show style framing device where each member of the team recounts a different seemingly unrelated adventure (which are all tied together by Doom) so we can get in some cool adventure bits featuring various villains like Mole Man and Annihulis and whoever. In between all of these we can squeeze in some familial drama. Reed's to focused on his work, Maybe Sue doesn't know how to tell him she's preggers, Johnny and Ben get up to mischief.

I think Id play up to the normies idea that they're outdated by having the TV show think something like that too, that they're too out of touch and try to make them look more EXTREME but in the end the team's bond is what saves the day and wins over the TV execs convincing them there is place for a family hero team

Fuck, just when it looked like some of those restrictions were being loosened.

For those that don't know, all this is happening because of one man. Isaac Perlmutter, president of Marvel. He hates that they don't own the movie rights to Spider-Man, X-Men and the FF. It was fine when they weren't making movies, but once Marvel Studios started and he couldn't get the rights back, he wanted to go scorched Earth. To him, he doesn't want to promote what he considers someone else's products in Marvel movies by Sony and Fox. If someone is going to make money, it's going to be him.

Spider-Man is too big. He is the face of Marvel, you can't cancel it, you can't kill his merch, he is on that untouchable level with Batman and Superman. The X-Men are pretty damn big too, and canceling them outright would have been dumb. But you can see Ike's fingerprints all over everything that's happened with them. He wanted to turn the Inhumans into Mutants, take all that fear and oppression storytelling (and most importantly, popularity) and twist it towards something he can profit on. It's why they were pushed as replacements to mutants, it's why he pushed Feige to make an Inhumans movie, it's why there's now an Inhumans tv show after Feige broke Marvel Studios away from the rest. Even then, the X-Men are still popular. They still show up in some games and toys. They're not completely dead.

But the Fantastic Four? That he can kill. The book didn't sell that well anymore. The characters aren't as beloved as the rest. Hell, you could make an argument that canceling it for a couple years then relaunching it would be a good move to generate interest. But it's petty to completely scrub them from the universe as if they didn't exist just because you don't want Fox to make a couple extra bucks.

My first exposure was late 90's comics and the first movie, instantly liked the idea of stretchy powers and solid rock body powers but later became a Doom-fan because reasons and from what I saw and read, the Four have that same legendary status even Ike can't kill. Marvel has the comic merch and presumably shares of any cartoon merch; FOX has the movie merch rights.

However, even though FOX keeps fucking up the movies, they probably can point to the amount of merchandise they sell, compared to the amount Marvel sells (even at a peak since 2005, when FOX's first movie came out) and argue that some fraction of Marvel's sales since then has been due to cross-promotion of what are in effect two separate but highly similar brands.

It's a very complex argument and one that, on the face of things, you might assume is doomed to failure and a court returning Marvel the FF rights or ordering FOX to stop being dicks about merch rights, but that's not why you bring copyright cases; very rarely does a company (in this case Marvel Comics, which is nowhere near as rich as Marvel Studios, who have nothing to do with the FF - and that's exactly why you break up your assets, to prevent this kind of corporate raid) have the money to pay costs and damages (which can run very high); conversely, if you're bringing a suit, you may find yourself receiving only a small amount of money - not enough to cover your costs. This is important to both sides because the first thing you do when you're sued is... counter-sue.

However if FOX were to come to court with an argument like this (and they'll have been rattling off letters about that possibility), it would be simpler for both sides to settle and agree terms between themselves. Ruinous, pointless court case averted, everybody gets money, right? Wrong. Because FOX would almost certainly be getting more than they have now.

So to protect the FF - to prevent FOX from owning them in whole, forever, and their never appearing in any Marvel media again - it's necessary for the time being to remove them as a team - no headline book, no claim that FOX is driving its sales with a shitty movie (because even the shittiest movie sells millions more tickets than any comic book sells issues).

Marvel can use Skrulls, just not Super-Skrull (because he has the FF's powers combined and is explicitly part of their rights). But as with Quicksilver and the Scarlet Witch (and likely Beast), Marvel having the shared rights to characters isn't necessarily something they want to use.

The Fantastic Four are suppose to be Marvel's FIRST FAMILY. They can't really be that when Avengers, GOTG, etc are all formed and accounted for. Them being in the 60s allows them to precede all those characters, while utilizing the 60s aesthetic that is so heavily tied to them.
