It's iffy. With head injuries you can always argue it's from something unrelated because you can't actually see a concussion with xrays or anything like that. So long as they felt secure that Tyson was being humiliated, they were fine with it. When he gave off the impression that he was in on the joke in S2, there was a little alarm, but it died down. If it was well-known that he's OK with the liberties they take with him on the show, most would consider that to be "getting away" with it.
