Same reason he doesn't lock up Catwoman. He both cares deeply about Jason and believes that he is ultimately still a good person, and believes that locking him away would not only NOT save him, but just push him further away (something he desperately wants to avoid).

He also serves as a reminder of his flaws both as a person and a hero.
