It's not as difficult as it sounds.

FIrst, make mutants register using the SHRA, or the NFA. Civil war was such a clusterfuck that I'm not sure if mutants were ever properly covered under that, but if not, it's not a big push politically to change that. If the courts balk that it's based on genetics, limit it to "assault mutants".

Second, make Genoshia or wherever, as US protectorate, like Puerto Rico. This step is probably optional.

Third. Have congress declare formally declare war against mutant terrorism.

Fourth. Wait until the next major, world gets fucked up event in the X men books.

Fifth, Offer to relocate persecuted mutants for free to Genoshia.

Sixth. Set up a super prison on Genoshia specifically for mutant terrorists, ala Guantanamo.

Seventh. Declare extingent circumstances. Demand that all mutants be moved temporarily to Genoshia for everyone's safety. This is legal under Korematsu v. United States.

Eight. Declare a general travel ban to and from Genoshia. Enforce it with big purple robots if you like.

Nine. Expand the laws from just covering weaponized mutants to all mutants.
