They could LEGITIMATELY, as you put it, be deported under ANY administration.

As in it's a legitimate concern for em you numnutz. Most administrations aren't going to pull off dick moves like sending people who were being tortured/murdered back to their original country after they're accepted in as a refugee.

>Marvel kill to Beast Boy?

>>91867267
I know Xavier registered the institute as a certified educational branch but with the X-Men constantly doing shit that fucks with all of the world's governments on a daily basis you'd think that shit would be revoked or placed on moratorium by Fury, Hill, or even Vogt since he was and I think is still anti-mutant and pro-registration (he's not vocal about it because of Civil War 1 and Genosha).

Honestly the Heritage Group would be able to deport Inhumans as they gave up their American Citizenship to become part of the Inhuman hierarchy. While you could argue dual-citizenship the Inhumans haven't been the best at keeping the peace between non-Inhuman controlled nations, especially America.

If anything a good supervillain would deport Inhumans and Mutants to the same area and then show the truth about Terrigen Gas as SHIELD & Inhumans knew it killed mutants but were letting it happen because of "muh culture" and because they were bribing the governments with Ulysees during their Civil War 2 Minority Report Boogaloo. Then you let X-Men and Inhumans have the real race war they should of had during IvX somewhere far from civilization.

I'm not saying they would or should. I'm taking no stance on this other than that it is constitutional law that they can be deported for any reason, regardless of which administration is in office. A visa does not give you an unrevocable right to remain in the United States.

You want to talk about the Constitution. Let's take the first proposed travel ban, for example.

Here is what Judge Derrick Watson gave as his reasoning for blocking the order.

>"It is undisputed, using the primary source upon which the Government itself relies, that these six countries have overwhelmingly Muslim populations that range from 90.7 per cent to 99.8 per cent.
>“It would therefore be no paradigmatic leap to conclude that targeting these countries likewise targets Islam. Certainly, it would be inappropriate to conclude, as the Government does, that it does not.”

So he's saying "I conclude that this travel ban is aimed at Muslims." Even though the countries the ban would effect were designated by the previous administration as terrorist hotbeds.

But regardless of that, here is what the Constitution says in 8 U.S. Code § 1182 - Inadmissible aliens:

>"Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate."

Now tell me, which one is law and which one is legislating from the bench?

Children.
>>
>>91869545
The president literally said that he was aiming it at Muslims as a matter of history record to be preserved in the archives for the continued existence of the United States. You just want the judges to pretend to be retarded like you.
>>
>>91869545
>But regardless of that, here is what the Constitution says in 8 U.S. Code § 1182 - Inadmissible aliens:

That's part of federal law, but not part of the Constitution.
>>
>>91863572
Hey, X-Cutioner's back!
>>
>>91869624
An actual muslim ban would target far more countries than the ones listed.
>>
>>91869624
It literally doesn't make a difference if he was aiming it at people with red hair and green eyes who like the band U2. The President can stop anyone he chooses from entering this country.

>>91869645
You're right, I was getting ahead of myself. Though it is still the law and still stands.
>>
>>91869687
It's not everyone else's fault that he failed at it and is corrupt enough to be bribed.

The US has done and try'd do it before. Usually it's when a party uses a minority to gain power like with the Irish and other Catholics. We should have sent them back and we should've tried to do the same with many former slaves who still had connections to their old homes.
>>
>>91869857
Yeah, but this is some random dude who we know nothing about, and the implication is that he's done nothing wrong.
>>
>>91869837
The constitution applies only to US citizens.
Additionally, it didn't stop progressive hero FDR from putting Japanese people in the US into camps.
>>
>>91869837
Friend, the constitution does not apply to non-US citizens. Not only that, but the law says that the President can ban any group of people from entry for any reason at any time. So even if ot were a literal, full-on Muslim ban, it would be 100% lawful.
>>
>>91866269
Well, of course. The new racist group is controlling the brotherhood to foment racial tension so they can move their plans foward, so the brotherhood has to advertise they are EVIL MUTANTS. Are foreign nationals entitled only to reduced rights and
freedoms? The difficulty of the question is reflected in the
deeply ambivalent approach of the Supreme Court, an ambivalence
matched only by the alternately xenophobic and xenophilic
attitude of the American public toward immigrants. On the one
hand, the Court has insisted for more than a century that foreign
nationals living among us are "persons" within the meaning of
the Constitution, and are protected by those rights that the Constitution
does not expressly reserve to citizens. Because the Constitution
expressly limits to citizens only the rights to vote and to
run for federal elective office, equality between non-nationals
and citizens would appear to be the constitutional rule.

TLDR really shouldn't be used when something can be found within 30 seconds of reading from the start. Plus there's the entire rest of the misc documents so I'm really just taking a random part out of literally the entire thing.

oh well sure. Also he doesn't seem to have the staff and he looks tacticool-ed out. So it'll either be a trainee, a new guy or the original one who's gone nuttier.

Though I don't think anyone has used the X-Cutioner since he was floated as a Thunderbolt or something during Civil War I.

You do realize that the entire reason we had to use Guantanamo Bay for what it's used for is because it does and Guantanamo is in a unique legal loophole that enables them to ignore such pesky laws/rules?
>>
>>91870707

Why do we give Guantanamo Bay prisoners trials if they don't have the same rights under the constitution we have?
>>
>>91868316

Not only this but once the stay's reach a certain level within the judicial system, they'll be overturned anyway and then liberals might try to sue to lock it up in courts for awhile but ultimately every order that has been blocked so far will ultimately pass.

It's just liberal justices trying to legislate from the bench.

Republicans want this fight to happen now to cement presidental power for the future.
>>
I've tried so much to get into contemporary xmen comics and they always dissapoint- the great thing about xmen was always interpersonal drama between characters. This is just a self indulgent allegory story that does nothing to develop the characters held within it
>>
>>91871026

They're given military trials because military has a judicial system for prisoners of war.

Not same as being given a civilian trial with rights of United States Citizens, even though some democrats advocated for that.

They were sentenced under military tribunal.
>>
>>91868316
The problem isn't that they're being revoked. The problem is that they're being revoked as part of religious discrimination as admitted by the people doing it which is highly illegal.

it's got a lot of world rebuilding to do. But Uncle Guggie has given us glimices of what the characters arcs should be going forward.

Yes, it is constitutional.

People can disagree all they want based on whatever political garbage they can come up with, but when the supreme court gets ahold of this case there is only one way they can rule on it.

>>
>>91872543

Which is why they released the torture report, the difference is no president will allow kind of political sanctions to come against the presidency for fear of it being used against them or predecessors or future presidents, so while torture is illegal, they're ways for them to skirt it.

And you need to understand the laws of war are overly broad and open to interpretation. I mean technically speaking things like geneva convention have been skirted in last 20 years through the use of black sites.

We have power to do what we want, and we usually do. But there is also a need to be seen as 'the good guys' so often that hypocrisy bumps up next to military expediency or gets us into quagmires like what is happening between various kurds, iraqis, turks, syrians, russians etc.

Most countries would never have allowed something like torture report to come out but it most likely had the intent of making sure future presidencies couldn't pull the same shit.

Rachel's costume is not good for a psychic but it'd be great on a flying brick. I really like it. Just wish we got a clear shot of it this issue.
>>
>>91871867

The travel ban was blocked not on merits but the supposed 'intent' behind the travel ban and even centrist jurists realized that judges aren't supposed to weigh into that, they're supposed to preside on merits of the action in evidence.

When it gets to supreme court, trump will be vindicated, along with the sanctuary city funding cuts, (that's mostly symbolic till congress acts on it. ) pretty much everything liberal judges have blocked will end up coming out in favor of republicans.

The executive branch is unconstitutionally overpowered already.

All of that stuff happened in Logan's mind. He's thinking he escaped and calling the X-Men for backup but really he's luring them into Mesmero's trap.
>>
>>91870000
The implication was that he's a horrible person for hunting down and murdering a defenseless guy.
>>
>>91870266
He's written that way, which is part of why he's an effective stand-in for the original. He should have more nuance, but, y'know.
>>
>>91874239
Brotherhood of Evil Mutants (new) fights the X-Men and then bails after kidnapping Logan. Almost immediately thereafter they strike again somewhere else and kidnap the mayor (of NYC?). There's a new politician that's pushing for deportation of mutants and Inhumans.

I thought it was 4/10 but I'm not an xfag and it's still in the setup phase.

That's specifically been blocked because it's supposed to be a Congressional appropriation decision. If Congress passes it, there's not much its' opponents can do in court.

This is kind of dumb unless she specifically wants to start a new mutant nation somewhere, which doesn't seem part of the plan.

Also, I'm sure there is a good reason, but why don't the mutants live in a small section of Savage Lands or in the new uninhabited Blue Area of the Moon? Both probably cheaper than Central Park.

>>
Ok, I just read through the first two issues, and why are so many of the guys they're fighting "supposed to be dead"?

Terrax, Avalanch and Pyro are expressly said to have been dead and burried. Mesmero was killed by one of the Dark Riders.
Masque was killed by Cable, Mellencamp killed by Jamie Mardox. (And then they cleverly don't reveal his name.)

Did X-cutioner die at any point? How about Magma?

Have you considered that they don't want to live like hermits out in the middle of nowhere? Would you want to just pack up and leave your home because some other motherfucker doesn't like you?

I mean, to be honest Utopia was excellent and that whole period of X-Men history was great compared to what we have no, but it makes sense that most mutants wouldn't want to leave their homes to go live in shitty dinoland.
