Any lawyer can send a letter. Cease and Desist letters only demonstrate the copyright owner's awareness of the material. They're might scare off 16 year olds making fan games, but they're hardly evidence of what a judge would decide if they actually went to court. And Nintendo is no stranger to fair use for their own sake (see King Kong vs Donkey Kong).

Also yes Nintendo did get all pissy over the fan games even though they didn't ask for money but you need to think for a second about why they did? The most likely reason they did go after those games was because they didn't want the chance of anyone playing those games instead of any new ones they bring out. If a new Metroid game came out (which one never will bcus MAMA MIA) there's the possibility that people would rather just play one of the fan games rather than buy it for various reasons such as the game being expensive, them not having Nintendo consoles or hand held, the games sucking ass etc.

If fan games get popular enough through word of mouth then it can reduce sales. Granted that it will be a very minute effect on sales at the end of the day Nintendo is all about making money and they don't want fan games making even the smallest dent in profits. Remember these fan games aren't just some little flash game or browser game, they're fully developed games.

One last thing Nintendo wouldn't (or least most likely wouldnt) bother with the "A fox in Space" series because its just a non canon cartoon and not a video game. You'd still have to buy starfox from nintendo to experience the genre you cant gain any experience from a youtube animation

Creating a videogame based on a videogame series that's extremely similar to the videogame it's based on, is understandable for a cease and desist, Especially considering how odd copyright laws get in regards to videogames. Pokemon Uranium simply could've just modified the pokemon sprites, and names just a little and it actually would've been completely legal. (On a side not AM2R, it literally was Metroid 2 which they were currently selling on the eshop, it would've made sales worst as why would you buy the original metroid 2 on the eshop when you can download a superior remake for free?)

A Fan animation will probably be fine as it won't possible distract from the sales of the series (hell it'll probably keep it up) or be confused for an official product.

Im honestly just suprised we never hear anything about all those pokemon games on the google playstore, although to be fair there not well known and can usually only be accessed via ads on youtube/tumblr and do a decent job hiding the pokemon and characters they stole in the screenshots they display on the playstore screen.
